在华工作注意事项NOTES ON THE EMPLOYMENT IN CHINA
针对的是想要在中国合法工作的外籍人士，就是《中国公安机关举报违法犯罪外国人奖励办法（试行）中的第六条：外国人非法就业、非法聘用外国人、介绍外国人非法就业的。

根据《中华人民共和国出境入境管理法》第四十一条：外国人在中国境内工作，应当按照规定取得工作许可和工作类居留证件。任何单位和个人不得聘用未取得工作许可和工作类居留证件的外国人。
In accordance with Article 41 of the Exit and Entry Administration Law of the People's Republic of China, aliens who work in China shall obtain work permits and work-type residence permits in accordance with relevant regulations. No unit or individual shall employ foreigners who have not obtained work permits or work-type residence permits.
第四十三条：外国人有下列行为之一的，属于非法就业：
（一）未按照规定取得工作许可和工作类居留证件在中国境内工作的；
（二）超出工作许可限定范围在中国境内工作的；
（三）外国留学生违反勤工助学管理规定，超出规定的岗位范围或者时限在中国境内工作的。
Article 43 Aliens who engage in any of the following acts shall be regarded as illegal employment:
(1) working in China without obtaining a work permit or a work-type residence permit in accordance with relevant regulations;
(2) working in China beyond the scope of the work permit;
(3) Foreign students work in China beyond the prescribed post scope or time limit in violation of the regulations on the administration of work-study.
第八十条：外国人非法就业的，处五千元以上二万元以下罚款；情节严重的，处五日以上十五日以下拘留，并处五千元以上二万元以下罚款。
Article 80 Aliens who illegally work shall be fined not less than 5,000 yuan but not more than 20,000 yuan; If the circumstances are serious, he shall be detained for not less than five days but not more than 15 days and shall, in addition, be fined not less than 5,000 yuan but not more than 20,000 yuan.
介绍外国人非法就业的，对个人处每非法介绍一人五千元，总额不超过五万元的罚款；对单位处每非法介绍一人五千元，总额不超过十万元的罚款；有违法所得的，没收违法所得。
非法聘用外国人的，处每非法聘用一人一万元，总额不超过十万元的罚款；有违法所得的，没收违法所得。
Those who introduce foreigners for illegal employment shall be imposed a fine of 5,000 yuan for each person illegally introduced, not exceeding 50,000 yuan in total; A fine of 5,000 yuan for each person illegally introduced to the unit, not exceeding 100,000 yuan in total; If there are any illegal gains, the illegal gains shall be confiscated.
Whoever illegally employs a foreigner shall be fined 10,000 yuan for each person illegally employed, not exceeding 100,000 yuan in total; If there are any illegal gains, the illegal gains shall be confiscated.
综上，对于外籍人士来说，在中国违法犯罪后果是十分严重，不仅会造成经济上的损失，对后续其他签证申请、延期、换发都会有不利影响！尤其是工作许可证或中国绿卡申请时，国内无犯罪证明是其中必不可少的文件，如果有了以上犯罪逾期记录，申请会难上加难！
